Year In Review: Pitre & Associates accumulated over $1,000,000 for our clients in combined settlements, damages awards, and salary retention in 2021!!

We are extremely proud of the many accomplishments and the valuable assistance we were able to bring to our clients in 2021. Over the span of a year, we were able to finally bring justice to a EEO complaint that was filed in 2016, thwart several attempts by Federal Agencies to unjustifiable remove and/or subject our clients to discplinary actions, and we were able to settle numerous EEO complaints to our client’s satisfaction.
Here’s a breakdown of what we were able to achieve in 2021:
  • P&A settled 14 cases, where we negotiated over $410,000 in compensatory damages and attorney’s fees for our clients.
  • P&A was able to get Federal Agencies to rescind 3 proposed adverse actions, including 2 proposed removals.
  • P&A was victorious during a 5-day hearing against the Department of Veterans Affairs, proving that the Agency discriminated and retaliated against our client, and thus, awarded $236,171.51 in attorneys’ fees and costs, $137,000 in compensatory damages, and $50,385.26 in back-pay, resulting in a $423,556.77 total award.
  • P&A successfully argued before the U.S. Court of Appeals for the Federal Circuit that a Merit Systems Protection Board decision, denying our client corrective action in her claims filed under the Whistleblower Protection Act, was unsupported by substantial evidence, and thus, should be vacated and remanded further deliberation. This was the second MSPB decision P&A got overturned on appeal at the US Court of Appeals for the Federal Circuit.
  • P&A appealed an improper dismissal of client’s EEO complaint by the US Postal Service and received a decision in its favor from the EEOC’s Office of Federal Operations, which reinstated our client’s case for further processing.
  • Managing Partner, A. Marques Pitre, was acknowledged as a 2021 Lawyer of Distinction©.

Pitre & Associates successfully secures another US Court of Appeals for the Federal Circuit vacate and remand order on a MSPB Whistleblower IRA Appeal.

Managing Partner, A. Marques Pitre, once again successfully argued before the US Court of Appeals for the Federal Circuit that a Merit Systems Protection Board decision denying our client corrective action in her claims filed under the Whistleblower Protection Act was unsupported by substantial evidence, and thus, should be vacated and remanded further deliberation. The Court adopted Mr. Pitre’s argument that in conducting its Carr analysis, the Board’s decision failed to consider certain evidence that may have detracted from its overall conclusion, and thus, it’s finding that the Agency met its clear and convincing evidence burden of proof could not be upheld.

Pitre & Associates wins historic EEOC victory against the Department of Veterans Affairs resulting in close to a half a million-dollar monetary award.

In 2016, Ms. Potter retained Pitre & Associates to assist her with a discrimination complaint against the Department of Veterans Affairs. After five hard fought years of zealously representing Ms. Potter during the complaint process, and ultimately at an EEOC hearing against the Agency, the firm’s Managing Partner, A. Marques Pitre, successfully argued the merits of the case during a 5-day hearing before an Administrative Judge and obtained a decisive victory on behalf of Ms. Potter. The Judge found the Department of Veterans affairs discriminated against Ms. Potter on the basis of Race, Sex, and Retaliated against her based on her prior EEO Activity. In addition, the Judge found that the DVA subjected Ms. Potter to harassment resulting in a hostile work environment based on her Race, Sex, and in Retaliation. The Judge awarded Ms. Potter $236,171.51 in attorneys’ fees and costs at current Laffey rates, $137,000 [1] in compensatory damages, and $50,385.26 in back-pay, resulting in a $423,556.77 total award.

Senior Associate Michelle de Vera negotiates $73,500 settlement in client’s [1] workplace harassment and reprisal complaint against the Department of the Navy.
After years of enduring harassment based on sex and reprisal, the Client reached out to Pitre & Associates to assist her with her Formal EEO Complaint. The firm assisted the Client in navigating the EEO Investigative process, and ensured the Client provided the testimony and documentary evidence necessary to prove her claims. Shortly after requesting an EEOC hearing, Pitre & Associates was able to successfully settle the Client’s case due to evidence we were able to acquire and have included in the Report of Investigation. The settlement agreement included correcting the Client’s inaccurate performance appraisal, $65,000 in compensatory damages; and reimbursement of $8,500 in attorneys’ fees, for an award totaling $73,500.

Pitre & Associates successfully negotiates $70,000 settlement in client’s Merit Systems Protection Board case against the Department of the Treasury

After being wrongfully removed from federal service, client retained Pitre & Associates for representation before the Merit Systems Protection Board (“MSPB”).  During this very difficult and trying time, Pitre & Associates successfully guided the client through the MSPB process, and was able to settle the matter, prior to a hearing.  The settlement agreement provided our client with a reinstatement to federal service, back-pay, including benefits and interest, and attorneys’ fees for a monetary award totaling approximately $70,000.

May 1, 2020
The client contacted the firm in late 2018 after being terminated from his private sector position, on the day of orientation, due to a perceived physical disability. Upon filing an EEOC disability discrimination charge at the Washington, DC EEOC field office, the firm assisted the client through the investigative process, and ultimately filed a  federal civil complaint at the U.S. District Court for the District of Columbia. However, prior to discovery in that matter, the firm was able to negotiate settlement without having to take the client through a lengthy, and potentially costly, court battle. This victory awarded our Client $50,000 in non-pecuniary compensatory damages, $7,854.57 in back-pay, and a full reimbursement of attorneys’ fees at the current Laffey Rate; for a full award totaling approximately $75,000.00.

Pitre & Associates successfully secures a US Court of Appeals, Federal Circuit remand on a MSPB Whistleblower IRA Appeal

A. Marques Pitre successfully argued before the US Court of Appeals that the decision by the Merit Systems Protection Board denying our Client corrective action in her claims filed under the Whistleblower Protection Act were arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law; obtained without procedures required by law, rule, or regulation having been followed; or unsupported by substantial evidence.
The Court ruled in favor this firm, and in doing so, vacated and remanded a portion of the case back to the MSPB for further deliberation. You can review the Opinion of the Court below.

A brief synopsis of the cases are as follows:
1) Client’s[1] case had been dormant for over 6 months when he contacted the firm for representation in his matter. Pitre & Associates, LLC has Successfully Settled 4 Cases in the First Half of 2019, Totaling Over $100,000 in Damages and Attorney Fees

Pitre & Associates has been extremely successful over the first half of 2019 in negotiating excellent settlement agreements on behalf of its clients. A brief synopsis of the cases are as follows:
1) After unsuccessfully battling with the Agency to grant a Reasonable Accommodation request, Client[1] filed an EEO complaint for disability discrimination and reached out to our firm to assist in the representation of that case during the EEOC process. Concurrently, the Agency had issued Client a Notice of Proposed Removal. Pitre & Associates successfully negotiated the cancellation of that Notice of Proposed Removal, payment of approximately 6 months of Client’s salary, a neutral reference letter, and 4 months on the Agency roles to find a new position; totaling approximately $40,000.

After working with the client for over 2 years, Client’s case finally came to a successful conclusion, when we were able to successfully negotiate a settlement that included a lump sum payment of $10,000, reimbursement of the cost to obtain a Certification License, promotion to a higher grade after completion of the License,, and reimbursement of Client’s attorney’s fees at the current Laffey Rate; totaling approximately $36,000.
3) In an effort to remove himself from a toxic work environment at the Farm Credit Administration, Client[3] reached out to Pitre & Associates to assist in the filing of an Informal Complaint for Disability discrimination. After being on the matter for less than 10 days, this firm was able to negotiate an agreement that allowed the Client to receive a lump sum payment of $20,000; receive 2 weeks paid leave; and a reimbursement of full attorney’s fees at the current Laffey rate; totaling approximately $23,000.
4) Client[4] reached out to Pitre & Associates in April 2019 because of issues with the Agency concerning a Reasonable Accommodation request denial, a FMLA request denial that led to the Client being threatened with being placed on AWOL, and continued workplace harassment from Client’s first-line supervisor. After filing an Informal Complaint, and during the mediation of said complaint, we were able to negotiate a settlement that included; Client being transferred from under the supervision of the alleged harassing supervisor, being placed on a work schedule commensurate to her previously denied Reasonable Accommodation request, receiving the training opportunities that were previously denied, and a reimbursement of full attorney’s fees at the current Laffey rate; totaling approximately $4,000.

Associate Michelle de Vera successfully negotiates client’s [1] ability to continue to telework 100%% while she deals with a debilitating disability.

November 1, 2018
After threat of the removal of her ability to perform the essential functions of her position while under a Reasonable Accommodation, and also being issued the directive to go on unpaid short-term disability; the client reached out to Pitre and Associates for assistance. After working on the case for just over three months, this firm was able to secure the client’s position with the Agency and allow her to continue to perform her duties under a 100%% telework agreement.

After a 2- and 1/2-year fight, where the Agency only provided the client with an initial settlement offer of $5,000. However, the client bravely stayed the course and allowed Pitre & Associates to continue to fight his case with the guidance that based on the facts in his matter, a positive outcome would result. Consequently, prior to proceeding to an EEOC hearing, the Agency finally relented and settled the case under client’s terms of approximately $50,000 which included 2018 Laffey rate attorney’s fees. Pitre & Associates Successfully Settles Sexual Harassment Suit Against the U.S. Department of Veterans Affairs

Attorneys Michelle de Vera and A. Marques Pitre Successfully Negotiate $50,000 Settlement in Client's [1] Sexual Harassment Suit Against the U.S. Department of Veterans Affairs.
The client, after experiencing unwanted touching, and an inappropriate sexual comment from a fellow Agency employee, filed a Formal Complaint of Sexual Harassment against the Agency. When the client made it to the EEOC Hearing phase of her case, she reached out to the firm to acquire assistance with her matter. Within 2 months of representation, this firm was able to negotiate a settlement agreement that included a $50,000 award including attorney’s fees at the 2018 Laffey Rate, the client receiving one additional day of telework per week, and a new workspace completely away from her offender.
